Unit Outline

This unit provides an overview of the major forms of intellectual property protection in Australia. The unit focuses upon the statutory systems of copyright, trade marks and patents. Related areas including protection for trade secrets, passing off and the protection provided by Australian Consumer Law are addressed more briefly.

Intended Learning Outcomes

On completion of this unit, you will be able to:


1	Identify legal issues and applicable laws relevant to practical problems involving intellectual property rights
2	Explain the impact of international law on Australia's domestic intellectual property law and policy
3	Apply legal reasoning skills including statutory interpretation in identifying, researching and resolving practical problems arising in relation to intellectual property rights
4	Effectively communicate and work individually, as well as part of a team, while identifying, researching and resolving practical problems arising in relation to intellectual property rights

Assessment details

Assessment Task 1: Assessment Task 2: Tutorial problem analysis

Task Description:

Students will be required to provide a written report analysing one of the IP-Law problems discussed during the tutorials.
During each tutorial, following class discussions of the relevant problem, students will be provided with supplementary questions to which they will be required to respond in their written report.
The tutorial evaluation must be submitted by 10am on the Monday in week 6 for copyright law, week 10 for business reputation law and study break for patent law/trade secrets. .

Assessment Task 2: Assessment Task 1: Case analysis Q&A

Task Description:

Students will be provided with a list of three intellectual property law cases, which they will be required to analyse and report on, in the form of a one-on-one question and answer session with one of their lecturers via video conference.
Students must be prepared to discuss all three cases on the list. However, during the video-conference, the lecturer will select two of those cases as the focus for discussion. Students will not be notified, in advance of the video-conference, which two cases have been selected by the lecturer
In relation to each of the chosen cases, students will be asked about the nature of the dispute, the legal issues, the outcome, and the consequences for the development of the law in the area.
The Q&A session will be scheduled during week 6 for copyright law, week 10 for business reputation and study break for patent law/trade secrets.

Assessment Task 3: Assessment Task 3: Problem solving advice

Task Description:

Students will be provided with an intellectual property law problem which they will be required to analyse and respond to in the form of written professional advice to a hypothetical client.

The problem solving advice must be submitted on the Monday in week 6 for copyright law, week 10 for business reputation law and study break for patent law/trade secrets.

How your final result is determined

To pass this unit, you need to demonstrate your attainment of each of the Intended Learning Outcomes, achieve a final unit grade of 50% or greater, and pass any hurdle tasks.

Submission of assignments

Where practicable, assignments should be submitted to an assignment submission folder in MYLO. You must submit assignments by the due date or receive a penalty (unless an extension of time has been approved by the Unit Coordinator). Students submitting any assignment in hard copy, or because of a practicum finalisation, must attach a student cover sheet and signed declaration for the submission to be accepted for marking.

Requests for extensions

If you are unable to submit an assessment task by the due date, you should apply for an extension.

A request for an extension should first be discussed with your Unit Coordinator or teaching support team where possible. A request for an extension must be submitted by the assessment due date, except where you can provide evidence it was not possible to do so. Typically, an application for an extension will be supported by documentary evidence: however, where it is not possible for you to provide evidence please contact your Unit Coordinator.

The Unit Coordinator must notify you of the outcome of an extension request within 3 working days of receiving the request.

Late penalties

Assignments submitted after the deadline will receive a late penalty of 5% of the original available mark for each calendar day (or part day) that the assignment is late. Late submissions will not be accepted more than 10 calendar days after the due date, or after assignments have been returned to other students on a scheduled date, whichever occurs first.
